1. Scope / General information
www.zephirparrucchieri.ch is the online shop and website of Salone Zéphir by Fernandes Sacramento Ana, hereinafter Zephir . These general contract conditions (hereinafter referred to as CG) apply to all services provided by www.zephirparrucchieri.ch . The services offered by www.zephirparrucchieri.ch are limited to the geographical area of ​​Switzerland and Liechtenstein. By placing the order, the customer expressly declares to agree with these general contract conditions, valid for all services offered by Zephir's online shop ( www.zephirparrucchieri.ch ).
Zephir may modify the general contract conditions valid for www.zephirparrucchieri.ch at any time. Such changes become effective immediately upon their posting.

2. Products and offers
The complete offer on www.zephirparrucchieri.ch is not binding. Zephir strives to indicate correct product descriptions, however these may differ from those of the manufacturers. Zephir assumes no responsibility for the correctness, completeness and topicality of these descriptions. In any case, we invite you to take note of the specific information on the product indicated on the relevant packaging before using it. The images and illustrations of the product contained on www.zephirparrucchieri.ch may differ from the original, and the colors indicated are not binding.

3. Prices
The prices of the products indicated on www.zephirparrucchieri.ch at the time of the customer's order are binding. In the event of an error in the price, Zephir reserves the right to change the price thereafter. In this case, the customer is informed of this circumstance and can refrain from purchasing, within the deadline established by www.zephirparrucchieri.ch . Unless otherwise stated, all prices are in Swiss francs, including VAT and excluding shipping costs, unless otherwise stated. The products are usually shipped with our shipping partners Swiss Post or other couriers such as Economy or Priority. Shipping costs may vary depending on the value of the order and are paid by the customer, unless otherwise indicated. During checkout you will see the relevant shipping cost.

4. Registration
Registration at www.zephirparrucchieri.ch is reserved exclusively for people with full legal capacity. By ordering, the customer guarantees that he is at least 18 years old, that he is not prohibited and that he is capable of discernment. There is no fee for admission to the online shop. The data necessary for registration must be indicated by the customer completely and truthfully. The customer himself is responsible for updating his data.


5. Order / Conclusion of contract

The customer's order is binding only if it has been confirmed via e-mail by www.zephirparrucchieri.ch . Zephir is free not to confirm an order without giving reasons. With his order, the customer confirms the correctness of all the information provided by him. In case of incorrect or incomplete customer data Zephir may withdraw from the contract. Even if the products are not available from the manufacturer, Zephir has the right of withdrawal. In this case, after consulting the customer Zephir tries to find an alternative solution. If the customer does not need it, there are no further rights and obligations of the two contracting parties.

6. Delivery
Zephir has a large stock of products. The goods that are ordered and confirmed until 6.00 pm are received by our customers within 1-20 working days. If individual goods are not available from stock, the time of dispatch may be delayed, depending on the manufacturer's delivery times. Delivery times are always non-binding and delays in delivery do not justify requests for compensation for damages or the possibility of withdrawal from the contract by the customer. The customer is obliged to examine the supply immediately after receipt and to return incorrect or unsatisfactory supplies to Zephir within 14 days. All products returned for other reasons will be invoiced to the customer. The returned products must be unused and 100% intact to be sold, otherwise the refund of the amount spent will be null or partial at the discretion of our team's evaluation. Zephir only provides the geographical area of ​​Switzerland and Liechtenstein.

7. Transfer of risk
The risk passes to the customer as soon as the shipment has been entrusted to the company carrying out the transport. If shipment is delayed or becomes impossible through no fault of Zephir , the risk passes to the customer upon notification of availability for shipment. A transfer of transport costs agreed in individual cases by Zephir has no influence on the transfer of risk.

8. Payment methods
Customers can usually pay by PayPal, credit card (Master-, Visa- and Diners-Card), Postcard, prepayment, TWINT, or by invoice. The payment process in any case takes place via secure SSL encryption technology. The currently active payment methods will be shown during checkout before completing the order.

8.1 Purchase on account with installment option (POWERPAY)
MF Group / POWERPAY offers the payment method "purchase on invoice" as an external payment service provider. With the purchase by invoice method you can simply pay for the purchase you made online via invoice. If you choose not to pay within the specified time period, you will receive a monthly invoice the following month, along with an order summary.

At the time of conclusion of the purchase contract, POWERPAY assumes the invoice request that has arisen and manages the related payment methods. In case of purchase by invoice, the user accepts, in addition to our GTC, the POWERPAY GTC (powerpay.ch/it/agb).

8.2 Biller Zephir
If Zephir itself acts as the invoice issuer, it has the right, if the payment deadline indicated on the invoice is exceeded, to demand reminder fees of up to CHF 50 per reminder to partially cover the costs incurred. The reminder can be sent by email, in writing, by post or by telephone. In the event of unsuccessful reminders, Zephir can assign the debt to a third party responsible for collection or start the procedure itself. The collection company will claim the outstanding amounts in your name and on your behalf and, like Zephir , may collect additional processing and collection fees.

9. Retention of title; compensation; right of retention
(1) Until the invoice amount is paid in full, the item purchased by the consumer remains our property. In the case of entrepreneurs carrying out their independent commercial or professional activity, legal entities under public law or special funds under public law or any person who has concluded the purchase in our online shop zephirparrucchieri.ch, we reserve ownership of the object purchased until all outstanding credits arising from the business relationship with the customer are paid. The relevant warranty rights are transferable to third parties.

(2) You will only be entitled to compensation if your counterclaims have been legally established or are undisputed or recognized by us. Furthermore, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.

(3) If the customer is in default with any payment obligations towards us, all existing claims become due immediately.

10. Quantity restriction
In any case, Zephir reserves the right to limit the supply quantities for certain products.

11. Right of return / Right of withdrawal
We grant you the right to return products purchased from us within 14 days of receipt. The date of shipment of the goods is decisive for compliance with the deadline.
Returned products or packages will only be accepted in perfect condition, i.e. undamaged, unused, unopened and in the original packaging.

The return costs are borne by the customer, upon request we will send you instructions for proceeding with the return. You can request further information by e-mail (info@zephirparrucchieri.ch) or by telephone, on +41 91 791 36 38 .

In any case, the customer is responsible for packing the goods to be returned so that they can be transported. Damage/loss of goods due to improper packaging will be charged to the customer. If the customer hands over the goods to a transport company, the risk for the safe transportation of the goods is assumed by the customer. The transfer of risk to Zephir occurs only when the goods arrive at Zephir's headquarters in perfect condition for resale .

If an order is accompanied by a gift (GWP = gift with purchase) of a certain purchase value, restrictions apply when returning the goods. If the entire order is returned or if the new purchase value falls below the GWP requirement, the gift must also be returned. If the GWP is not returned under these circumstances, the value of the gift will be invoiced.

Intolerances or allergies
Zephir assumes no responsibility for any allergic reactions or related consequences. In case of allergic reactions after using a product, this must be reported by the customer no later than 1 month after purchasing the product (info@zephirparrucchieri.ch) so that the further procedure can be defined. In any case, it is advisable to photograph the allergic reaction and/or obtain a medical certificate/allergy card and consult your doctor.

12. Warranty
The warranty conditions of the product suppliers apply. These are attached to the products. Zephir assumes no further warranty. In any case the customer is required to contact Zephir to clarify how the warranty management is carried out. The choice of services covered by the guarantee is the sole responsibility of the suppliers. In the case of devices, the possibility of repair is always checked first. Warranty services are the exclusive responsibility of the customer and cannot be transferred. Damages due to improper use, natural wear and tear or external influences for which the seller is not responsible are the responsibility of the customer and do not constitute a warranty case.

13. Deadline for notification of defects
Defects must be notified in writing within 14 days of receipt of the goods. Otherwise, the goods are considered to be free of defects and accepted by the customer.

 

14. Transport damage
Transport damage must be communicated in writing within 5 days of receiving the order both to the Swiss Post or to the relevant courier and to Zephir. The risk of transport damage is borne by the customer, unless he can transfer it to the transport service provider.

15. Data protection
The provisions of our data protection declaration apply to data protection and form an integral part of these GTC.

16. Responsibility
Zephir excludes, within the scope of the law, any liability for direct and indirect damages (e.g. as a result of accident and/or injuries suffered for products supplied by Zephir) towards the customer. Breach of the contract, impossibility of execution, negligence at the time of stipulation and/or illicit acts do not under any circumstances justify claims for compensation for damages or the right to terminate the contract.

A case of liability must be reported in writing to info@zephirparrucchieri.ch within 20 days of shipment of the goods (delivery of the shipment to the transport company in charge); after which, any subsequent claim lapses.

17. Applicable law / competent court
The contract is governed exclusively by the Code of Obligations and other provisions of Swiss legislation.

The competent court for all disputes with Zephir is - subject to deviation from the mandatory places of jurisdiction according to federal law - Locarno Campagna, Switzerland.
